SmileAlarm
These Terms govern your use of the SmileAlarm app (the "App"). By installing, launching, or using the App, you agree to these Terms. If you do not agree, please stop using the App.
1. Relationship to Apple's standard EULA
The App is distributed under Apple's Standard End User License Agreement ("Apple EULA"). By installing and using the App, you also agree to the Apple EULA. These Terms set out App-specific rules in addition to the Apple EULA. In case of conflict regarding App-specific matters, these Terms take precedence.

2. Alarm functionality and smile detection
The App schedules system-level alarms using Apple's AlarmKit framework and detects smiles using ARKit face tracking and the BlendShapes API.
- No guarantee of alarm reliability: Alarm delivery depends on many factors including iOS, AlarmKit, device power, available storage, speaker, notification settings, Focus modes, and accessibility settings. We do not guarantee that the alarm will sound under all conditions
- Always use a backup for important schedules: For business trips, exams, interviews, transportation departures, or any other schedule where oversleeping could cause significant harm, you must use multiple alarm methods (the built-in Clock app, a physical alarm clock, a wake-up call from another person, etc.) in combination with the App
- No guarantee of smile detection accuracy: Smile detection accuracy varies with lighting, camera angle, physical condition, individual facial differences, and OS version. We make no warranty as to detection accuracy or speed
- Camera and face data: Camera footage and face data are processed only on-device in real-time and are not transmitted externally. See the Privacy Policy for details
- System requirements: The App runs only on iOS 26.1 or later with a TrueDepth-camera-equipped iPhone (iPhone X or later). Some or all features will not work on other devices
3. Prohibited conduct
When using the App, you must not:
- capture or share face data of third parties without their consent
- disclose or publish photos saved or displayed by the App without the consent of the people shown
- infringe other people's portrait rights, privacy rights, or other rights
- investigate vulnerabilities in the App, reverse-engineer, analyze, or modify it (except to the extent permitted by law)
- attempt unauthorized access to the App, the subscription system, or the advertising system, or attempt to bypass authentication or billing
- interfere with the App's operation or place undue load on the App or related servers
- otherwise act in violation of laws or public order and morality
4. Subscriptions
The App offers auto-renewing subscriptions (monthly and yearly) to unlock Pro features. General matters such as payment, auto-renewal, cancellation, and refunds follow the Apple EULA and App Store policies.
- Auto-renewal: Subscriptions auto-renew each period unless you cancel. If you do not cancel at least 24 hours before the end of the current period, the payment method registered to your Apple ID will be charged automatically
- How to cancel: Cancel from "Settings → Apple ID → Subscriptions" on your iPhone, or from the App Store app. You can also reach the management page from the App's settings screen
- No pro-rated refund: Per App Store rules, you can use Pro features through the end of the current period after cancellation; there is no pro-rated refund for the unused portion
- No refunds for subjective dissatisfaction: Due to the nature of digital content, we cannot offer refunds for subscriptions based on subjective satisfaction or "the feature wasn't what I expected." Please review the Pro feature list and free-plan limits before purchase
- Refunds follow Apple's policy: All subscription refunds are processed by Apple. We cannot process individual refunds. Please request refunds directly from Apple (Apple support page)
- Price changes: We may change subscription prices in the future, in accordance with Apple's policies. When a price change occurs, advance notice will be given as required by Apple's policy. If you do not agree to the new price, please cancel
- Changes to Pro features: We may add, change, or remove Pro features without notice. Material changes will be announced on this page, in the App, or on the store page
5. Advertising
For free-plan users, the App displays banner and native ads via Google AdMob on selected screens. No ads are shown for Pro subscribers. Ad targeting is performed using your advertising identifier (IDFA) only when you grant App Tracking Transparency (ATT) permission. See the Privacy Policy for details.
6. Disclaimer
- "AS IS" and "AS AVAILABLE": The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty as to fitness for a particular purpose, accuracy, completeness, uninterrupted operation, or freedom from defects
- Damage from alarm failure: We are not liable for any oversleeping, lateness, missed schedules, financial loss, lost opportunities, reputational harm, or any other damage caused by the App's alarm failing to sound or sounding at an unexpected time
- Damage from smile-detection issues: We are not liable for any damage caused by the App failing to detect a smile, falsely detecting a smile, or being slow to detect
- Data loss: We do not guarantee that on-device data, iCloud data, smile photos, smile logs, alarm settings, or subscription information will not be lost. Please back up important data separately
- Third-party service changes and outages: The App's features may become unavailable due to changes, outages, or discontinuation of third-party services from Apple (iOS, AlarmKit, ARKit, iCloud, StoreKit, App Store), Google (AdMob, Firebase Analytics, Firebase Crashlytics, Google Forms), or others. We are not responsible for the resulting impact
- Cap on liability: To the extent permitted by law, our total liability to you is limited to the most recent subscription fee you paid for one billing period (one month for monthly, one year for yearly) at the time the damage occurred. If you have not paid us anything (free plan), the cap is JPY 3,000
- No liability for indirect damages: To the extent permitted by law, we are not liable for indirect, consequential, special, or incidental damages or loss of profits (including lost opportunities, damage from data loss, reputational harm, or claims by third parties) arising from use or inability to use the App
- Consumer-law exception (Japan): If you are a consumer under Japan's Consumer Contract Act, the limitations above do not apply to damages caused by our willful misconduct or gross negligence
7. Eligibility and use by minors
- The App is intended for users at least old enough to obtain an Apple ID under Apple's terms
- If you are under 18, please use the App with the consent and supervision of a parent or guardian. Subscriptions must be purchased with the permission of your parent or guardian. We do not process refunds for purchases made by minors without parental consent (you may file a refund request with Apple under Apple's policy)
- The App is not primarily intended for children under 13. If a child under 13 uses the App, please ensure ongoing parental supervision and use Apple's Screen Time and Ask to Buy features for safety
8. Smile photos and your responsibility when sharing
- You are responsible for clearing third-party rights: Smile photos taken by the App may include people other than you. If you share or publish such photos, you are responsible for obtaining consent and clearing related rights such as portrait rights and privacy rights
- Sharing-feature liability: If, by using sharing or social-network features the App may provide now or in the future, you publish photos to third parties and infringe their rights, you bear that responsibility, and we accept none
9. Modification, suspension, and termination of the service
- Minor changes: We may modify the App to fix bugs, improve features, or respond to specification changes by third-party services (AlarmKit, ARKit, iCloud, StoreKit, AdMob, etc.). For minor changes, we may not provide individual advance notice
- Material changes and feature suspension: For material changes such as suspending core functionality, restructuring Pro features, or changing billing conditions to your disadvantage, we will make reasonable efforts to notify you in advance via in-app notification or the store page
- Permanent service termination: If we permanently terminate the App, we will make reasonable efforts to notify you at least 30 days before the planned termination date via in-app notification or this site. This does not apply in the event of unforeseen termination of third-party services (such as Apple's), material specification changes to AlarmKit or ARKit, legal requirements, or other unavoidable circumstances
- Unused subscription periods: If we permanently terminate Pro features during an active auto-renewing subscription period, refunds for the unused portion may be requested from Apple under the App Store refund policy. We will cooperate with any refunds determined at Apple's discretion
- Data after termination: After service termination, smile photos, smile logs, and alarm settings stored on your device and in your iCloud (CloudKit private database) remain available for you to view and export for as long as iOS and iCloud functionality continues. We will not delete your iCloud data (we cannot access it)
10. Changes to these Terms
These Terms may be updated as needed. Material changes will be announced inside the App or on the store page. Updated Terms take effect from the time they are posted on this page. If you do not agree with the updated Terms, please stop using the App.
11. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute regarding the App is subject to the exclusive jurisdiction of the Japanese court having jurisdiction over our location, as the court of first instance. If you are a consumer under Japan's Consumer Contract Act or other applicable mandatory law, this section does not override rights granted to you under such law.
12. Acceptance
By launching and using the App, you are deemed to have accepted these Terms and the linked Privacy Policy. If you do not accept these Terms, please stop using the App.
